Terms of Service

The terms governing use of goZurch, its church-community services, and optional third-party integrations including YouTube API Services.

1. Agreement and Operator

These Terms of Service ("Terms") are an electronic agreement between you and ZPTEM, the operator of goZurch ("goZurch", "we", "us", or "our"). They govern your access to the goZurch mobile application, websites, APIs, and related services (together, the "Services"). By creating an account, accessing or using the Services, or selecting an acceptance checkbox, you agree to these Terms and acknowledge the Privacy Policy. If you use the Services for a church or another organization, you represent that you have authority to bind that organization, and "you" includes both you and that organization where applicable. If you do not agree, do not use the Services.

2. Eligibility

You do not have to be 18 to use goZurch's general community features. If you are under 18, a parent or legal guardian must permit your use and provide any consent required by applicable law. Some features may be unavailable until the required consent or safeguards are in place. You may not use the Services if applicable law prohibits you from doing so or if we previously terminated your account for serious misuse. You must be at least 18 years old and legally capable of acting for a church to create or register a church in goZurch or accept these Terms on its behalf. You must provide accurate information and keep it current. A church does not have to be formally incorporated merely to maintain an informational profile, but you must accurately describe its legal and registration status. Verification, offerings, payouts, or paid features may require additional eligibility, identity, organizational, banking, or regulatory documentation.

3. Accounts and Security

You are responsible for your account, devices, credentials, and activity performed through them. You must: • use your own accurate contact information; • keep passwords, one-time passwords, and access tokens confidential; • promptly update inaccurate information; • notify support@zptem.com of suspected unauthorized access; and • avoid sharing an account when individual role-based access is available. We may require email, device, identity, or other verification. You may not impersonate another person, create deceptive accounts, evade restrictions, sell accounts, or use another person's credentials without authorization. For church registration and verification, authorized leaders may be asked to provide an image of the church’s PAN card or organizational registration documents through an official verification flow. You must submit only genuine documents you are legally authorized to provide. Such images are used solely for fraud prevention and legitimacy verification, subject to the Privacy Policy.

4. The goZurch Services

The Services may allow you to discover churches based on location and preferences; join church communities; communicate with members; view or publish church profiles, services, events, announcements, meetings, testimonies, prayer requests, and YouTube content; receive notifications and calendar reminders; submit reports; make offerings; and purchase promotional services. Features may vary by location, account type, church role, verification status, device, or third-party availability. We may add, modify, suspend, or discontinue features for operational, legal, security, or commercial reasons. Where reasonably practical, we will provide notice of a material discontinuation. Where enabled, church ledger tools may let authorized users record or view income, expenses, assets, liabilities, balances, and related records. Ledger information is supplied and maintained by the relevant church or its authorized users; goZurch does not independently certify its accuracy or provide accounting, audit, or tax advice.

5. Church Profiles, Verification, and Administration

If you create, claim, or manage a church, you represent and agree that: • you are authorized to act for that church and to submit its information and documents; • church, registration, contact, location, service, bank, and payout information is accurate and lawfully provided; • you will maintain appropriate member roles and permissions and remove access that is no longer authorized; • you will obtain permission before submitting another person's contact details, image, identity document, or other personal data; • fundraising, events, communications, and use of funds will comply with applicable law and the purposes represented to users; and • you will cooperate with reasonable verification, fraud, safety, and compliance requests. Verification is a risk-control process, not an endorsement, accreditation, or guarantee. We may approve, reject, request corrections or additional documents, re-review, suspend, or remove a church profile. Processing times are estimates only and are not guaranteed. goZurch may monitor and review activity carried out through a church profile, including public content, reports, promotions, and transactions, where reasonably needed for verification, safety, fraud prevention, legal compliance, or enforcement of these Terms. We may request updated information, correct platform-controlled status or labels, limit visibility or features, pause a promotion or payment, remove content, or suspend a church account when warranted. We will give notice where practical, except when doing so would compromise safety, an investigation, or a legal obligation. Church deletion: An authorized church representative may request deletion of a church profile through the available in-app controls or by contacting support. We may verify the requester's authority and may require resolution of pending offerings, payouts, disputes, legal holds, or other obligations before completing deletion. Deletion may remove public church information and end associated features, but transaction, security, dispute, and legally required records may be retained. Where other authorized leaders or members have legitimate access, the request may require additional confirmation.

6. Your Content and License

You retain ownership of content you lawfully submit, including text, photographs, documents, announcements, messages, testimonies, prayer requests, and church information ("User Content"). You grant goZurch a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, adapt for technical display, transmit, and display User Content solely to operate, secure, promote, and improve the Services according to your selected audience and settings. This license lasts while the content is available through the Services and for a reasonable period in backups, legal records, or cached copies. Public content may be copied or shared by other users outside our control. You represent that you own or have all rights and permissions necessary for User Content and that its use as described here will not violate law, confidentiality, privacy, publicity, intellectual-property, or contractual rights.

7. Acceptable Use

You must not use the Services to: • commit fraud, misrepresent a church, misuse offerings, launder money, or evade sanctions, tax, or financial rules; • threaten, harass, exploit, discriminate against, defame, or endanger another person; • publish unlawful, sexually exploitative, hateful, violent, deceptive, infringing, or malicious content; • expose another person's sensitive data without a lawful reason and appropriate permission; • spam, scrape, harvest data, send unauthorized promotions, or manipulate rankings, impressions, payments, or engagement; • upload malware or interfere with accounts, networks, security controls, APIs, or the operation of the Services; • reverse engineer or copy the Services except where applicable law expressly permits it; or • assist another person in doing any of the above. You can report users, churches, or content through available reporting tools. Our moderation team reviews reported violations within 24 hours and takes proportionate action, including limiting visibility, removing content, restricting features, preserving evidence, suspending accounts, or notifying authorities. Content and community safety: Do not send threatening, harassing, abusive, defamatory, discriminatory, or otherwise harmful messages in group chats. Use available reporting tools to report a message, image, member, or church. We review reported material and relevant context within 24 hours and take proportionate action, including warning a user, removing or restricting content, limiting features, suspending or terminating an account or church, or referring a matter to appropriate authorities where warranted. Images and announcements must be lawful, authorized, and appropriate for goZurch. Do not upload illegal, exploitative, hateful, violent, infringing, deceptive, or privacy-violating images. Announcements and promotional posts must be related to the church, ministry, event, or other purpose permitted by the relevant feature. We may remove unrelated, misleading, unlawful, or otherwise non-compliant posts and may restrict the responsible account.

8. Offerings, Payments, Fees, and Payouts

goZurch facilitates payments through third service providers, such as Razorpay. The applicable amount, currency, platform fee, and net amount are calculated for the transaction and shown where required before confirmation. Fees may differ by transaction, currency, church, plan or provider; no fixed fee applies unless displayed for that transaction. Payment authorization, capture, refund, chargeback, settlement, and payout are subject to provider rules, bank processing, verification, and applicable law. goZurch does not guarantee that a payment or payout will be accepted or completed by a particular time. We may delay, reverse, or restrict a transaction where reasonably necessary for fraud, error, dispute, compliance, sanctions, or security review. An offering marked anonymous may still be identifiable to goZurch, payment providers, banks, and authorities. Unless a valid receipt expressly states otherwise, goZurch does not represent that a payment is tax-deductible. Donors and churches are responsible for their own tax, accounting, fundraising, foreign-contribution, and charitable-compliance obligations. Domestic offerings and FCRA compliance: All offerings and donations must be made in Indian Rupees (INR) from domestic Indian payment methods and bank accounts. In compliance with the Foreign Contribution (Regulation) Act, 2010 (FCRA), contributions from foreign sources, foreign bank accounts, foreign cards, or foreign citizens are strictly prohibited unless the receiving church independently holds a valid and active FCRA registration certificate issued by the Ministry of Home Affairs, Government of India. Donors and churches are solely responsible for ensuring compliance with all tax, charitable, and foreign-contribution regulations. A successfully processed offering is final and non-refundable at the donor’s request after it has been directed to the selected church. Failed, duplicate, unauthorized, or incorrectly charged payments may be reviewed for a refund or reversal where required by applicable law, payment-provider rules, or a confirmed payment error. Contact support promptly about a payment problem. Platform fees: Any platform fee, payment-provider fee, and the amount payable to or received by the church will be shown for the transaction where required before confirmation. Payments are processed by Razorpay or another displayed provider under that provider's terms. The applicable fee treatment may vary by transaction and law; goZurch does not promise that an offering is tax-deductible.

9. Promotions and Paid Visibility

Eligible users or churches may purchase promotional placement for churches, announcements, or ministry-related content. The price, duration, target, estimated reach, and other applicable terms shown at purchase form part of these Terms. Promotion does not guarantee a specific number of views, interactions, members, donations, or other outcome unless we expressly provide a written guarantee. Estimated reach and performance information are estimates. Promotional content must be accurate, lawful, properly authorized, and compliant with these Terms. We may reject, pause, or remove non-compliant promotions. Once a promotion payment has been successfully processed and the placement has begun, the payment is non-refundable if the purchaser cancels, deletes the promoted content, ends the promotion early, or does not receive the results hoped for. This does not limit refunds or reversals for a failed, duplicate, or unauthorized charge, a promotion that was not delivered as purchased, payment-provider requirements, or applicable law; any more favorable refund term expressly shown at purchase also applies. If an authorized church representative deletes an announcement while its paid promotion is active, the promotion and featured placement end when the announcement is deleted. No refund, credit, or extension is provided for the unused portion solely because the church chose to delete the announcement, except where applicable law requires otherwise or the terms shown at purchase expressly provide otherwise. Promotion cancellation and refunds: Promotional payments are non-refundable after the promotion has started if the purchaser cancels it, deletes the promoted content, or chooses to end it early. This rule does not exclude refunds or reversals required by law, payment-provider rules, failed or duplicate payments, unauthorized charges, or a promotion not delivered as purchased.

10. Third-Party Services

goZurch uses third-party services including Google, YouTube, payment providers, and external links. Their own terms and privacy policies may apply. By using goZurch, you agree to be bound by the YouTube Terms of Service. YouTube controls its videos, player, advertising, and playback restrictions. Do not use goZurch to download YouTube videos or bypass those restrictions. goZurch is not sponsored or endorsed by YouTube or Google. Third-party services may change or become unavailable. You can disconnect optional integrations through available settings or the third party’s controls.

11. Location, Calendar, and Notifications

Nearby results require location information. Calendar synchronization requires the Google permissions shown during authorization. Push notifications require a valid device token and operating-system permission. These features are optional unless clearly identified as necessary for a requested function, and you can disable them through available app, account, Google, or device settings. Disabling access may stop the related feature from working and may remove future goZurch-created reminders where supported.

12. goZurch Intellectual Property

The Services, including their software, design, databases, branding, and original content, are owned by or licensed to ZPTEM and protected by applicable law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services for their intended purposes. Except for your User Content and rights expressly granted here, you may not copy, sell, sublicense, distribute, modify, create derivative works from, or commercially exploit the Services without written permission. Feedback you voluntarily provide may be used without restriction or payment, but we are not required to use it.

13. Suspension, Deactivation, and Deletion

You may deactivate your account in the app. To permanently delete it, use Profile → Danger Zone → Permanently Delete Account and confirm the action. Deletion closes account access, ends church memberships and notifications, and anonymizes the former user's identity in retained community content as described in the Privacy Policy. If you are the last pastor of an active church, assign another pastor first. Deactivation is temporary and does not erase data. Closing your personal account does not automatically delete a church managed by other authorized leaders; an authorized church leader may contact support separately about church deletion. We may restrict, suspend, or terminate an account, church, content, promotion, payment feature, or integration when we reasonably believe it is necessary to address a Terms violation, fraud, legal or payment risk, security concern, harm to users, prolonged inactivity, or discontinuation of the Services. Where appropriate and lawful, we will provide notice and an opportunity to appeal through support. Terms that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, dispute terms, and licenses needed for retained records—will survive. Reports and monitoring: Users may report a church, member, message, image, announcement, or promotion through available reporting tools. We may monitor and review relevant content and activity, including group-chat content that is reported or otherwise reasonably necessary to investigate safety, fraud, security, or Terms violations. We may investigate and take action based on the seriousness and context of the issue, including removing content, issuing warnings, limiting visibility or features, suspending or terminating a member or church account, pausing a promotion or payment, or notifying authorities where appropriate. We may delete or disable a church profile for serious or repeated violations, fraud, unlawful activity, safety risks, or legal requirements. Where practical and lawful, we will provide notice; we may withhold notice when necessary to protect people, preserve an investigation, or comply with law.

14. Important Disclaimers

goZurch is a technology platform. Unless expressly stated, we are not a church, religious authority, charity, bank, payment institution, tax adviser, or professional counsellor. A profile, verification status, promotion, event, sermon, testimony, prayer request, or other content does not constitute our endorsement or guarantee. Users and churches are responsible for evaluating each other, their content, events, fundraising, and safeguarding practices. Do not use goZurch for emergency assistance. Contact local emergency services or qualified professionals when needed. To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not promise uninterrupted operation, error-free content, particular results, or permanent availability of any feature. Nothing in these Terms excludes warranties or rights that applicable consumer law does not allow parties to exclude.

15. Limitation of Liability

To the maximum extent permitted by law, goZurch and its personnel will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, goodwill, data, opportunity, or anticipated savings arising from the Services. To the maximum extent permitted by law, our aggregate liability arising from the Services will not exceed the greater of (a) the fees you paid directly to goZurch during the 12 months before the event giving rise to the claim, or (b) INR 10,000. This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of confidentiality or data-protection duties where liability cannot lawfully be limited, or any other liability that applicable law does not permit us to exclude or limit.

16. Organizational Indemnity

If you use the Services on behalf of a church or organization, then, to the extent permitted by law, that organization will defend and indemnify goZurch against third-party claims and reasonable costs arising from its User Content, fundraising, events, authorized leader actions, breach of these Terms, or violation of another person's rights or applicable law. This section does not require indemnification for loss caused by goZurch's own fraud, wilful misconduct, or liability that cannot lawfully be excluded.

17. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before filing a claim, you and goZurch agree to attempt in good faith to resolve the dispute by written notice and discussion for at least 30 days. Subject to mandatory consumer rights and any forum that applicable law allows you to use, courts having jurisdiction over the operator's principal place of business in India will have jurisdiction. Nothing prevents either party from seeking urgent injunctive relief or using a legally available consumer or regulatory complaint process.

18. Changes to These Terms

We may update these Terms to reflect changes to the Services, fees, providers, risks, or law. We will update the date above and provide reasonable additional notice of material changes through the app, email, or another appropriate channel. Changes apply prospectively from their effective date. If a change requires renewed consent, we will request it. If you do not agree to revised Terms, you must stop using the Services and may delete your account.

19. General Terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, restructuring, financing, or sale of the Services, subject to applicable law. These Terms, the Privacy Policy, and transaction-specific terms presented to you form the entire agreement concerning the Services and replace prior versions on the same subject.
